Terms and Conditions of Sale

OVERVIEW

This website is operated by Mills & Boon Australia, a division of Harlequin Enterprises (Australia) Pty Limited ABN 47 001 180 918. For our details see our Contact Us page. Throughout the site, the terms “we”, “us” and “our” refer to Mills & Boon Australia.

This page together with our Privacy Policy and Terms of Use provides information about us and the legal terms and conditions (‘Terms’) on which we sell or supply any of the products (‘Products’) listed on our website (‘our site’) to you. These Terms apply to any contract between us for the sale or supply of products to you (each a ‘Contract’). Where we refer to a 'sale' or 'supply' in the context of an eBook product, this refers to the sale or supply of a licence to you to use the eBook product in accordance with these Terms of Sale.

Before placing an order on our site, you will be asked to agree to these Terms. Please read these Terms carefully and make sure that you understand them. If you refuse to accept these Terms of Sale, you will not be able to order from our site.

You must register for a personal Mills & Boon account (‘Account’) to make purchases from this site.

These Terms apply to the following types of products throughout our site:

  • Print book purchases
  • Print book subscriptions
  • eBook purchases
  • eBook subscriptions

You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your computer to prevent unauthorised access to your Account. You agree to accept responsibility for all activities that occur under your Account and/or password. You must take all necessary steps to ensure that the password is kept confidential and secure.  You should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Your Account, username and password are not transferable to any other person and may be used for non-commercial purposes only.

Accuracy of billing and account information: We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

eBooks purchased with your Mills and Boon Account use an eBook file link provided by our fulfillment partner VitalSource and an e-reader called Bookshelf. See further details below and read our GUIDE TO EBOOKS before purchasing.

 

UPDATES TO THESE TERMS  

We may change applicable Terms from time to time. If we update these Terms, amendments will be posted on the affected web site(s) and we will send you an email with a link to the updated Terms. We will, where practicable, endeavour to give you 28 days prior notice of changes to the Terms. If you object to changes to the Terms, you may cancel your subscription as set out in SUBSCRIPTIONS and RETURNS AND REFUNDS below.

PRICING AND AVAILABILITY

All of our prices are in Australian dollars (AUD) and include GST (Goods and Services Tax).

We reserve the right to correct any pricing errors and we may cancel orders and refund your money because of genuine pricing errors (either because of unilateral mistake, or for any reason) up to the time you receive the product.

Products shown on our site are subject to availability. We will inform you by phone or e-mail as soon as possible if any product you have ordered is not available or to let you know if we may have to cancel your order (or that part of the order which relates to a product which is out of stock).

OUR PRODUCTS

Each Product sold or supplied by us is subject to our and/or our author’s and licensor’s intellectual property and other proprietary rights including, but not limited to, copyright, registered and unregistered trade mark rights, rights in designs and database rights. Without prejudice to the express terms of any notices or end user licence terms contained herein,  all intellectual property and other rights in the Products are reserved by the relevant rights holder absolutely and no Product nor any part thereof may be used, reproduced, distributed, transmitted, communicated to the public or otherwise exploited by you in any way contrary to law without the express prior written permission of the relevant rights owner.

In the case of eBook products, except as otherwise provided below, you are granted a limited licence to download a single copy of an eBook in EPUB format to an installed reader on your computer, tablet or mobile device for use by a single user of that device at any time, subject always to the following conditions:

  • the eBook is not distributed, broadcast or transmitted over any network or by other communications method or otherwise communicated to the public;
  • the eBook is used for personal, non-commercial purposes only;
  • the eBook is not copied or modified in any way; and
  • no copyright, trade mark or other proprietary notices contained in the eBook are removed, obscured or otherwise amended.

The above licence is personal to you and may not be transferred or sub-licensed to any third party.

eBOOKS – VITALSOURCE “BOOKSHELF”

eBooks purchased using your Mills & Boon Account use an eBook file link and e-reader app called Bookshelf provided by our fulfillment partner VitalSource.

 

The Bookshelf reader app must be downloaded to your reading device, or accessed via your browser. A reading device includes iOS, iPadOS, Android, Kindle Fire and Chromebook.  For the avoidance of doubt, Bookshelf only works on 4th generation or later Kindle Fires. 

 

For the best user experience and to optimize your access to your eBooks, we recommend that you also create a VitalSource account. This is separate to your Mills & Boon Account (with separate login details). VitalSource do not handle any payment details. For instructions see our GUIDE TO EBOOKS.

 

Use of the Bookshelf app and use of your VitalSource account are subject to VitalSource licence terms and conditions, privacy policy and digital rights management which restrict the ability to copy, paste and print.

 

You acknowledge that some aspects of the eBook products entail our ongoing involvement and that of our fulfillment partner, VitalSource. If we or our fulfillment partner change any part of the eBooks, you acknowledge that you may no longer be able to use the eBooks to the same extent as prior to such change or discontinuation.  If we are aware that such a change will be made and consider, in our reasonable opinion, that the change may be significantly disruptive, we will use our reasonable best efforts to notify you prior to the change.  However, to the full extent allowed by law, we shall have no liability to you in such case.

HOW WE USE YOUR PERSONAL INFORMATION

We only use your personal information in accordance our Privacy Policy. Please take the time to read it, as it includes important terms which apply to you.

HOW A CONTRACT IS FORMED BETWEEN YOU AND US

When you make an order, you will receive an acknowledgment email confirming receipt of your order.  This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved and our billing agent has debited your credit or debit card.

SUBSCRIPTIONS

Subscription will commence immediately on receipt by us of completed subscription details, including, when applicable, a successful payment. Confirmation of acceptance will be provided to you via your nominated email address.

We may amend the pricing schedule for print or eBook subscriptions by giving 28 days prior notice to you. If you do not cancel your subscription before the new pricing takes effect, we may alter your automatic payment arrangements accordingly.

CHARGING OF CREDIT CARDS

If we or our billing agent is unable to charge your credit card due to insufficient funds or other errors, then we or our billing agent will attempt to contact you to rectify the issue. If the issue is not resolved then the order will be cancelled.

DELIVERY

RETURNS AND REFUND POLICY

Before returning any book (whether faulty or change of mind), please call Customer Service on 1300 659 500 (Australia) or 0800 265 546 (New Zealand) or email: customerservice@millsandboon.com.au

Returns for defective or incorrectly shipped print books

If you have received a book that is incorrect, damaged or faulty, we will refund or replace the item.  

We may require evidence of the issue and may require you to return the book for assessment. If we ask you to return the book we will provide means to return by post at no cost to you. Items returned by post must be packed securely to prevent movement inside the package and ensuring the package is firmly enclosed.

Returns for change of mind for print books

For change of mind, contact us within 30 days of receiving your books to request a store credit. Credit for change of mind is at Mills & Boon discretion. If we do accept a change of mind return then you must pay return postage and will only be entitled to a store credit for the approved returned item, excluding your original shipping charge.

All change of mind returns must be packed securely with cardboard or bubble wrap protecting the item, packed to prevent movement inside the package and ensuring the package is firmly enclosed. Change of mind returns must be received by us in new and re-saleable condition. Where an item is returned for a change of mind without our approval, or has not been packed securely, or is not in a new or re-saleable condition when it arrives at our distribution centre, we are not obligated to provide a store credit and the item may be returned to you. We will contact you to advise of the return status.

Returns for change of mind for print books – subscription only

This section only applies to subscription print books.

You can cancel your print subscription at any time. For a refund, you must Contact us within 30 days from delivery of those items and you must return the books if we ask you to.

If we ask you to return the books we will provide means to return by post at no cost to you. Returns must be packed securely with cardboard or bubble wrap protecting the item, packed to prevent movement inside the package and ensuring the package is firmly enclosed. Returned items for a cancellation of subscription must be received by us in new and re-saleable condition. Where an item is returned for a cancellation of subscription without our approval, or has not been packed securely, or is not in a new or re-saleable condition when it arrives at our distribution centre, we are not obligated to provide a refund. We will contact you to advise of the return status.

eBook technical issues

If you experience any difficulty accessing or using the digital content, or a technical issue, then please contact Customer Service as soon as possible for assistance. If an eBook is defective, you are entitled to a replacement or refund and, if the defect amounts to a major failure to comply with a consumer guarantee under the ACL, you may be entitled to compensation for any other reasonably foreseeable loss or damage.

Change of mind for eBooks

A return for a change of mind is not possible for eBooks. 

Your rights under the Australian Consumer Law ('ACL’)

This Returns and Refund policy does not limit the rights you are entitled to under the ACL.

Our Products come with guarantees that cannot be excluded under the ACL ('consumer guarantees’). You are entitled to a replacement or refund for a major failure to comply with a consumer guarantee and may be entitled compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

APPLICABLE LAW

These Terms shall be governed by the laws of New South Wales, Australia. If any part of these Terms is found to be invalid or unenforceable, it shall be severed without effecting the remainder.
